Terms of Service

Gregarious is designed for students in grades 5-12 and the educators and families who support them. By creating an account, you confirm that you are eligible to use the Service under these terms.

Students under 13 may only use Gregarious with verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA). In a school setting, the school may provide this consent under applicable FERPA provisions. If you are a parent and your child is under 13, please ensure their account was created through your school or with your explicit consent.

Students 13-17 may use the platform with parental consent as documented through your school's enrollment process. If you are 18 or older, you may create an account on your own behalf.

Teacher and administrator accounts require a valid school email address. We reserve the right to verify school affiliation before granting elevated privileges.

Teachers who use Gregarious agree to use the platform only for genuine educational purposes and in accordance with their school's policies.

When teachers contribute questions or other instructional content to Gregarious, they represent and warrant that:

• --The content is their original work, or they have the rights to contribute it
• --It does not infringe any third-party copyright, trademark, or other intellectual property rights
• --It is appropriate for the intended student age range
• --It does not contain personally identifiable student information

Teachers retain full intellectual property ownership of original content they contribute. By submitting content, teachers grant Gregarious a non-exclusive license to use, display, and distribute that content within the platform for educational purposes.

Teachers are responsible for how they use student data visible through their Teacher Dashboard. Student data may not be shared outside the platform, used for purposes unrelated to instruction, or retained beyond what is necessary for teaching.

Students agree to use Gregarious for learning. Full stop. Academic integrity is foundational to what Gregarious is built for. You agree not to:

• --Attempt to circumvent the adaptive mastery system or falsify your progress
• --Use bots, scripts, or automated tools to answer questions or complete sprints
• --Share AI-generated answers in Studio content without disclosure
• --Share your login credentials with anyone
• --Access another student's account or data
• --Harass, bully, threaten, or harm other users through the platform
• --Upload content that is obscene, harmful, or illegal
• --Impersonate a teacher, administrator, or other user
• --Attempt to reverse-engineer or copy any part of the platform

Violations may result in account suspension or permanent removal from the platform, and may be reported to your school. We want Gregarious to be a place where real learning happens. Cheating the system only cheats yourself.

We take student data seriously. Student data is used solely to personalize learning, measure growth, and improve the platform. We will never sell, rent, or share student data with advertisers, data brokers, or any third party for non-educational purposes.

Gregarious operates as a "school official" under FERPA when schools contract with us. This means we may receive student education records and we handle them with the same protections that schools are required to apply.

Gregarious plans to operate a Teacher Royalties program (GAR). This program is in development, Fall 2026, and is not yet active. The detail below describes the design so teachers can make informed decisions about contributing items today.

When a teacher's contributed items are used by other classrooms, the teacher is designed to earn royalty credits based on usage volume and measured item effectiveness (calibration data and student outcome signal). Royalty rates and payout thresholds will be published in the Teacher portal under the GAR view when the program launches.

Items contributed before GAR launches will be eligible for royalties from the program launch date forward, not retroactively. Items that fall below minimum quality thresholds may be retired from active use; you will be notified, and royalty accrual on retired items ceases on the retirement date.

In development, Fall 2026. During the Fall 2026 CSP pilot there is no paid subscription. Pilot pricing: free. Post-pilot per-student, per-class, and per-school pricing is in development and will be published at gregarious.app/pricing after the pilot reports out.

When paid plans launch, the operational detail (billing cycle, payment processor, auto-renew behavior, refund window, invoice terms) will be published here and in the in-app billing surface before the first charge.

School and district licenses will be governed by a separate School Service Agreement. That agreement, when signed, supersedes these Terms for the institutional account where the two conflict.

The Gregarious platform, including its adaptive engine, scoring algorithms, design, brand, and system-generated content, is owned by Gregarious and protected by copyright, trademark, and other intellectual property laws.

Student-created content in The Studio (games, stories, music, code projects) belongs to the student who created it. Students retain the right to export or delete their content at any time. By posting Studio content on the platform, students grant Gregarious a limited license to display it within the platform for educational purposes only.

"Gregarious" and the Gregarious logo are trademarks of Gregarious. You may not use our trademarks without prior written permission.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or use the platform in ways that compromise its educational integrity. We will generally attempt to warn users before suspending accounts except in cases of serious violations.

You may close your account at any time by going to Settings > Account > Delete Account, or by emailing cgb003@gmail.com. Personal data will be removed within 30 days of a deletion request.

For school-contracted accounts, the school administrator controls account creation and termination for their students and staff. Termination of the school contract terminates all associated student accounts on the contract end date.

To the fullest extent permitted by law, Gregarious is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of learning progress data or any interruption of access.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim. If you have not paid us anything, our liability is limited to $100.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted or error-free, or that any particular learning outcome will result from using the platform. Adaptive learning systems are probabilistic. Individual results will vary.

We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability and fitness for a particular purpose.

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes will be resolved in the state or federal courts in Suffolk County, Massachusetts.

Before pursuing formal legal action, please contact us at cgb003@gmail.com to attempt informal resolution. We commit to responding within 15 business days.

We may update these Terms as the platform evolves. When we make material changes, we will notify active users via email and in-app notification at least 14 days before the changes take effect. Continued use after the effective date means you accept the updated Terms.

Minor changes (typo corrections, clarifications that do not alter your rights or obligations) may be made without advance notice. The "Last updated" date at the top always reflects the current version.

If you do not agree to the updated Terms, you may close your account before the effective date per Section 8.
